SMS Spammer Being Sued for $1 Billion

A couple of months ago we blogged about TextMarks $43 million dollar settlement for mobile spam the biggest settlement to date.  A Florida based company just got hit with a $1 billion SMS lawsuit.

According to the lawsuit, south of Florida was hit with unsolicited text messages encouraging them to sell their junk cars to the provided number. Below are some examples of the texts sent out:

A reporter who received one such text, decided to do a little reporting was able to find  the ring leader Gregorio A. Tejera and two of his cohorts. A Hallandale lawyer Scott Owen’s stepped in and filed a federal class action lawsuit on behalf of those effected. They are requesting $500 per text message (as per the TCPA), which once you add them all up  come out to an astonishing $1 billion dollars.

The likelihood of the junk car kings actually coughing up $1 billion dollars is very unlikely, but it will not be cheap. Keep an eye on the Tatango blog for any updates about this case.
