Sending text message spam is not cool, but allowing others to send text message spam through your platform is super not cool, and can result in costly class action lawsuits. Twilio found this out the hard way last year, when they allowed GroupMe to send unsolicited text messages through their platform.

I just received a class action lawsuit filed earlier this month against MyCashNow for sending unsolicited SMS messages. The lawsuit, which is embedded below, claims that consumers received the following unsolicited text message from the following long code (330) 564-6316 on or around December 6, 2011:

Maybe this is retribution for T-Mobile shutting down their short code back in 2010, but we’ve just learned that SMS provider Club Texting has filed a class action lawsuit against the major cell phone providers, the CTIA and even SMS aggregators.

Last year we broke the story about how Jiffy Lube was sending unsolicited text messages to consumers. It turns out, the text messages were being sent by SMS provider TextMarks on behalf of Heartland Automotive Services, who operates 435 Jiffy Lube stations.

Buried within the National Restaurant Association’s 2012 Restaurant Industry Forecast, I found an interesting statistic regarding text messaging frequency. Within the report, it says that 30% of adults would like to receive an email with daily specials, with 20% preferring daily dials via text message.

I’ll be the first to say that most mobile marketing infographics are just re-hashing statistics that are already out there. This makes most mobile marketing infographics pretty to look at, but not very insightful.

I feel like a proud father reading that SMS marketing is the number one most used tactic when it comes to marketers implementing a mobile marketing strategy. SMS marketing came in at 59.3%, with QR codes right behind at 53.3%.
